Can a Family Member Be Your IHSS Provider in California?
Yes — and thousands of California families do exactly this. The IHSS program allows most family members to be paid as the official caregiver for an eligible recipient. This includes spouses, adult children, siblings, parents, and other relatives.
Here is what you need to know about becoming a paid family caregiver through IHSS.
Who Can Be a Family Provider?
The following family members are generally eligible to enroll as IHSS providers:
- Adult children (18+) caring for a parent
- Spouses and domestic partners
- Parents caring for a disabled adult child (18+)
- Siblings, aunts, uncles, cousins and other relatives
- Non-relatives who live with or are close to the recipient
Are There Any Restrictions?
A few important rules apply:
Conservators Cannot Be Providers
If a family member is the court-appointed conservator or guardian of the recipient, they cannot also be the IHSS provider. This rule is designed to prevent conflicts of interest.Minor's Parents Have Hour Limits
Parents of minor children with disabilities can be IHSS providers, but the hours they are paid may be limited depending on how many hours are authorized and whether the care is considered parental obligation.Spouse and Domestic Partner Restrictions
Spouses and registered domestic partners can be paid IHSS providers, but only for authorized IHSS services — not for tasks considered part of basic spousal support. Your county social worker will clarify what is covered. How to Enroll as a Family Provider
Why This Matters for Minority Families
Many Latino, Armenian, Filipino, and other immigrant families already provide unpaid care to elderly or disabled relatives. IHSS allows that care to be recognized and compensated — keeping money in the family and the recipient at home with people they trust.
If you are caring for a family member with IHSS-qualifying needs and are not yet getting paid, contact your county IHSS office or Public Authority. You may be leaving thousands of dollars a year on the table.
