How to Calculate Overtime Pay as a California IHSS Provider
California IHSS providers are entitled to overtime pay under state law. The rules are different from standard employment — so understanding them correctly means the difference between being paid fairly and losing wages you have earned.
The Basic Overtime Rules for IHSS Providers
Under California's Domestic Worker Bill of Rights (AB 241) and IWC Wage Order 15:
- Daily overtime: Any hours over 9 hours in a single workday are paid at 1.5x your regular rate
- Weekly overtime: Any hours over 45 hours in a single workweek are paid at 1.5x your regular rate
Example: How to Calculate Your Overtime Pay
Assume your wage is $18.65/hour and you worked:
- Monday: 10 hours
- Tuesday: 9 hours
- Wednesday: 10 hours
- Thursday: 9 hours
- Friday: 8 hours
- Total: 46 hours
- Monday: 1 hour over 9 = 1 OT hour = $18.65 × 1.5 = $27.98
- Wednesday: 1 hour over 9 = 1 OT hour = $27.98
- 46 hours total − 45 threshold = 1 OT hour = $27.98
- But you already counted 2 OT hours daily, so the weekly OT applies to any hours not already counted at OT rate
Live-In Provider Overtime Rules
If you live with the recipient, different rules apply:
- Daily overtime threshold: 9 hours (same)
- Weekly overtime: 45 hours (same)
- But sleep time (up to 8 hours) may be excluded from hours worked
What If Your Timesheet Does Not Show Overtime?
If you submitted hours that should generate overtime but your pay stub does not reflect it:
You have 3 years to claim unpaid overtime under California law. Keep copies of your timesheets.
