IHSS Overtime Rules for California Providers
California IHSS providers have overtime rights. This is not widely advertised — but it is the law. If you work more than the daily or weekly threshold, you are owed additional pay. Here is exactly how it works.
The Legal Basis
The California Domestic Worker Bill of Rights (AB 241) and IWC Wage Order 15 guarantee overtime protection for domestic workers, including IHSS providers. These laws took effect in 2014 and were made permanent in 2016.
The Overtime Thresholds for IHSS Providers
IHSS uses domestic worker thresholds, not standard employment thresholds:
- Daily overtime: More than 9 hours in a single workday → 1.5x your regular rate
- Weekly overtime: More than 45 hours in a single workweek → 1.5x your regular rate
How Overtime Is Calculated
If your regular wage is $18.65/hour:
- Overtime rate = $18.65 × 1.5 = $27.98/hour
- Mon: 10 hours (1 hour OT)
- Tue: 10 hours (1 hour OT)
- Wed: 9 hours
- Thu: 9 hours
- Fri: 9 hours
- Total: 47 hours (2 daily OT hours, plus 2 more for weekly OT threshold)
Does IHSS Automatically Pay Overtime?
The ESP timesheet system is designed to calculate and flag overtime. However, it only works correctly if your hours are entered accurately. Always verify your pay stub shows overtime hours at 1.5x, not at your regular rate.
Providers Working for Multiple Recipients
If you work for more than one IHSS recipient, overtime is calculated across all IHSS work combined in a single workday or workweek. Both recipients' hours count toward the threshold.
