Rights of Undocumented IHSS Workers in California

California law is clear: your immigration status does not determine your labor rights. Undocumented IHSS providers have the same right to minimum wage, overtime, sick leave, and protection from retaliation as any other California worker.

Can Undocumented People Work as IHSS Providers?

Yes. California does not require IHSS providers to be U.S. citizens or have legal immigration status. You need a Social Security Number (SSN) or Individual Taxpayer Identification Number (ITIN) to process payroll and taxes, but ITIN is fully accepted.

What Rights Do You Have?

As an undocumented IHSS worker, you are entitled to:

  • Minimum wage and all negotiated IHSS wage rates
  • Overtime pay for hours over 9/day or 45/week
  • Paid sick leave under the Healthy Workplaces Healthy Families Act
  • Rest and meal breaks
  • Safe working conditions
  • Protection from discrimination and harassment
  • The right to file wage complaints without fear of immigration enforcement

Can Your Employer Report You to Immigration?

No — not in retaliation for asserting your rights. California Labor Code § 1019 makes it illegal for an employer to threaten to report immigration status to discourage a worker from filing a wage claim or asserting labor rights. Violations can result in civil penalties against the employer.

The California Labor Commissioner is prohibited from sharing your immigration status information with federal immigration authorities as a result of a wage claim you file.

If anyone threatens to report you to immigration authorities because you asked about your rights or filed a complaint:

  • Do not panic — this threat is itself illegal under California law
  • Document the threat (write down what was said, when, and who said it)

  • Can You Receive IHSS as a Recipient?

    California has expanded Medi-Cal to all income-eligible residents regardless of immigration status. Undocumented residents with full-scope Medi-Cal can also qualify to receive IHSS services.
