How IHSS Pay Rates Are Set in California

Unlike a single statewide wage, IHSS pay rates are determined at the county level. Each county’s Board of Supervisors negotiates a wage with SEIU 2015, the union that represents over 500,000 IHSS providers statewide. The state of California funds approximately 65–75% of IHSS wage costs; counties fund the remaining 25–35%.

Recent Wage Increases: What Changed in 2025–2026

California IHSS wages have increased substantially in recent years due to state minimum wage increases, union contract wins, and COVID-era care economy investments.

Key recent increases:

  • California state minimum wage increased to $16.50/hour on January 1, 2026
  • Multiple counties concluded new SEIU 2015 contracts with multi-year wage increase schedules in 2025

Overtime Rules and How They Affect IHSS Wages

IHSS providers working more than 8 hours in a day or 40 hours in a week earn overtime at 1.5x their regular hourly rate under California labor law.

IHSS overtime basics:

  • Daily overtime: 1.5x after 8 hours in a single workday
  • Weekly overtime: 1.5x after 40 hours in a workweek
  • Double time: 2x after 12 hours in a single workday
  • IHSS workweek: Sunday through Saturday

Overtime cap: Each IHSS recipient has a maximum authorized monthly hour limit (currently 283 hours per month for most recipients). Providers may not work more than the authorized hours without county approval. However, when authorized hours do result in daily or weekly totals that trigger overtime, providers are entitled to overtime pay on those hours.

Live-in provider rules: IHSS providers who live with their recipient have different overtime rules. Live-in providers are not entitled to daily overtime pay on the same schedule as non-live-in providers under the IWC Wage Order. However, they are still entitled to weekly overtime (over 40 hours). Sick Leave and Other Paid Benefits for IHSS Providers

In addition to hourly wages, IHSS providers in California are entitled to:

Paid sick leave: IHSS providers earn 8 days (64 hours) of paid sick leave per year, accruing at the rate of 1 hour for every 30 hours worked. Sick leave can be used for your own illness or to care for a qualifying family member. Unused sick leave carries over but is capped at 96 hours total accrual.

When do IHSS wages typically increase in California? However, working for multiple recipients does increase your total hours and overall earnings. Each recipient is considered a separate employer for IHSS purposes. Be aware of overtime rules when calculating total hours across multiple recipients, as hours from all IHSS recipients you work for count together toward daily and weekly overtime thresholds.

I’m a new IHSS provider — when does my pay start? IHSS pay begins from the date your enrollment is fully processed and your first authorized timesheet period begins. The enrollment process typically takes 4–8 weeks after submitting your application. During this time you are not yet authorized to work — beginning to provide care before enrollment is complete creates complications with back pay and program compliance. Once enrolled, you will receive payment for the current pay period within 3–5 business days of electronic timesheet approval.
